Este trabajo intenta analizar la concepción, naturaleza jurídica y garantía de los derechos económicos, sociales y culturales, en América Latina, así como las condiciones y medidas que pueden contribuir a su efectividad. Presenta tambien una propuesta de indicadores que pueden utilizarse en la supervision de la efectividad de esos derechos y de la proteccion que ellos han alcanzado, proporcionando información sobre la situactón latinoamericana y caribeña actual.

El texto que presentamos recoge las principales conclusiones que han derivado de los estudios sobre la Colección de documentos árabes del Archivo Histórico Provincial de Granada. Compuesta principalmente por documentos de carácter jurídico, el análisis del contenido de cada uno de ellos en relación con la materialidad del soporte y las tintas así como la coincidencia en el diseño y planificación de la página revelan el uso de idénticos protocolos de ejecución. Esta investigación nos está permitiendo, además, establecer coincidencias relevantes (...) relacionadas con los procesos de elaboración del papel entre los últimos años de permanencia de los árabes en la Península Ibérica y los primeros tras la incorporación del territorio a la Corona de Castilla y, sobre todo, con el modo de ejecutar el documento de archivo en sus formas externa e interna. This study reflects on the influence of Jasper’s thought on the work of Jeanne Hersch. Our hypothesis is based on the importance that Hersch attributed to the philosophical tradition as a way of carrying out a theoretical activity aimed at “communication” and articulated around the poietic dimension of the human being. The identification of certain nuclear categories in Hersch’s philosophy allows us to highlight certain distinctive features of her contribution, which characterize the different aspects of her reflection and materialize in (...) the attention to the present. The paper presents a teaching experience implemented in two Sociology of Work courses at two Spanish universities. The teaching practice consists of the leisurely, reflective and critical reading of a classic text of the Sociology of Work, after which the students must prepare a mind map, that is, a graphic representation in which ideas are schematically organized and associated. The analysis of the students’ responses to a questionnaire allows us to affirm that the practice of mind maps is a creative, (...) visual and useful method of synthesizing and memorizing a classic sociological text. Ser, pensar, ver, mirar son el sustrato de la escritura de María Zambrano, que se apoya y brota de una irrenunciable voluntad de pensar y trazar la palabra que la vida necesita. Por ello escribe con la intención de reconducir la filosofía a la concreción de la existencia, para hacer del pensamiento, como ha dicho Wanda Tommasi, una instancia mediadora capaz de llevar a la luz de la conciencia las realidades oscuras del cuerpo, del sentir, de la pasión. María Zambrano (...) se mueve en la frontera entre filosofía y poesía. En los ensayos de Entre el alba y la aurora alienta algo de la investigación filosófica que los unifica: la voluntad de hacer de la lectura experiencia y de la escritura su articulación. En todos ellos la investigación ha sido reflexión sobre el modo en el que la obra de esta autora nos interpela y sobre el porqué de esta interpelación, dirigiendo la atención al contexto de las propias expectativas, a lo que el encuentro con sus páginas obliga a recomponer, al sentido que de aquí nace abriendo posibilidades de comprensión e interpretación. María Zambrano ayuda a pensar el fondo originario del vivir personal y enseña a darle un cauce, pone así de manifiesto el sentido del filosofar, acción reflexiva dirigida a la apertura de un futuro en tarea de creación que no es impositiva, sino liberadora. Carmen Revilla Guzmán es profesora de Filosofía contemporánea en la Universidad de Barcelona. En el siguiente estudio se evalúa un panorama con respecto al comportamiento sociológico en un preámbulo tanto antes durante y después de esta crisis social que se está viviendo debido a la pandemia de hoy en día. Por ello para sustentar dicha investigación se realizó un censo en el cuál, mediante el uso de herramientas estadísticas, se pudo realizar una comparación entre un antes y un durante de la pandemia, lo cual facilitaría intrínsicamente a la predicción de una denominada post (...) pandemia. En este texto se pretende detallar el proceso y forma de la encuesta, al igual que los resultados obtenidos de la misma. Se proveen, además, posibles explicaciones para estos resultados, guiándose por las restricciones de salud nacionales como posibles razones para el cambio de comportamiento actual. Researchers working in the field of ecosystem services (ES) have long acknowledged the importance of recognising multiple values in ecosystems and biodiversity. Yet the operationalisation of value pluralism in ES assessments remains largely elusive. The aim of this research is to present a taxonomy of values and valuation methods to widen the evaluative space for ES. First, we present our preanalytic positions in regards to the values and valuation of ES. Second, we review different value definitions that we deem relevant (...) for the discussion of ES valuation. Third, we propose a taxonomy of ES values based on different conceptions of human–nature relationships. Finally, we present a taxonomy of different methods that can be used to recognise plural values in ES. This taxonomy for a plural valuation can help ES scientists and practitioners with their aim of representing people's multiple and context-specific ways of valuing nature. The taxonomy can also serve to pay broader attention to ES values that are overlooked or misrepresented in assessments that restrict their focus to monetary valuations. (shrink)

Bioethicists involved in end‐of‐life debates routinely distinguish between ‘killing’ and ‘letting die’. Meanwhile, previous work in cognitive science has revealed that when people characterize behaviour as either actively ‘doing’ or passively ‘allowing’, they do so not purely on descriptive grounds, but also as a function of the behaviour’s perceived morality. In the present report, we extend this line of research by examining how medical students and professionals (N = 184) and laypeople (N = 122) describe physicians’ behaviour in end‐of‐life scenarios. (...) We show that the distinction between ‘ending’ a patient’s life and ‘allowing’ it to end arises from morally motivated causal selection. That is, when a patient wishes to die, her illness is treated as the cause of death and the doctor is seen as merely allowing her life to end. In contrast, when a patient does not wish to die, the doctor’s behaviour is treated as the cause of death and, consequently, the doctor is described as ending the patient’s life. This effect emerged regardless of whether the doctor’s behaviour was omissive (as in withholding treatment) or commissive (as in applying a lethal injection). In other words, patient consent shapes causal selection in end‐of‐life situations, and in turn determines whether physicians are seen as ‘killing’ patients, or merely as ‘enabling’ their death. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Gene editing techniques, such as CRISPR, are being heralded as powerful new tools for delivering agricultural products and foods with a variety of beneficial traits quickly, easily, and cheaply. Proponents are concerned, however, about whether the public will accept the new technology and that excessive regulatory oversight could limit the technology’s potential. In this paper, we draw on the sociotechnical imaginaries literature to examine how proponents are imagining the potential benefits and risks of gene editing technologies within agriculture. We derive (...) our data from a content analysis of public comments submitted to the Food and Drug Administration’s 2017 docket titled “Genome Editing in New Plant Varieties Used for Food.” Our sample frame consists of 26 comments representing 30 agriculture and biotech companies, organizations, and trade associations. Our findings reveal three key sociotechnical imaginaries, including that gene editing technologies in agriculture: are not GMO but instead equivalent to traditional plant breeding; have the potential to usher in a new Green Revolution; and could facilitate the democratization of agricultural biotechnologies. We argue that forming and projecting these collective interpretations of the potential of gene editing technologies for crops and foods plays an important role in efforts by proponents to influence regulatory oversight, modes of governance, and build public acceptance. This research contributes to calls by science and technology studies scholars to investigate emergent concerns and imaginaries for novel technoscientific advances to help inform upstream models of public engagement and governance decisions. Despite continuing controversies regarding the vital status of both brain-dead donors and individuals who undergo donation after circulatory death (DCD), respecting the dead donor rule (DDR) remains the standard moral framework for organ procurement. The DDR increases organ supply without jeopardizing trust in transplantation systems, reassuring society that donors will not experience harm during organ procurement. While the assumption that individuals cannot be harmed once they are dead is reasonable in the case of brain-dead protocols, we argue that the DDR (...) is not an acceptable strategy to protect donors from harm in DCD protocols. We propose a threefold alternative to justify organ procurement practices: (1) ensuring that donors are sufficiently protected from harm; (2) ensuring that they are respected through informed consent; and (3) ensuring that society is fully informed of the inherently debatable nature of any criterion to declare death. Emotional stimuli (e.g. words, images) are often remembered better than neutral stimuli. However, little is known about how memory is affected by an environmentally induced emotional state (without any overtly emotional occurrences) – the focus of this study. Participants were randomly assigned to discovery (n = 305) and replication (n = 306) subsamples and viewed a desktop virtual environment before rating their emotions and completing objective (i.e. item, temporal-order, duration) and subjective (e.g. vividness, sensory detail, coherence) memory measures. In both (...) samples, a Partial Least Squares Correlation analysis showed that an emotional state characterised by high negative emotion (i.e. threat, fear, anxiety) and arousal was reliably associated with better memory in both objective (i.e. item) and subjective (i.e. vividness and sensory detail) domains. No reliable associations were observed for any temporal memory measures (objective or subjective). Thus, an environmentally induced state of negative emotion corresponds with enhanced memory for indices of episodic memory pertaining to “what” happened, but not necessarily “when” it happened. Indonesia is a multicultural country with hundreds of local languages used by Indonesians with Bahasa Indonesia as a national language and used by the mass media, in formal conversation, at all levels of education, and in written language. This study aimed to investigate whether speaking Bahasa Indonesia in public and at home or not, and whether speaking only Bahasa or besides Bahasa (another language) affects the performance of seven cognitive tests when the assessment was done in Bahasa Indonesia. In case (...) large effects will be obtained, this may demand different norm referenced scores. Data of 840 subjects, in age ranging from 16–80 with various levels of education from six regions were included. The results showed that there was a small disadvantage in the Digit Span for people who do not speak Bahasa Indonesia in public and a small advantage of speaking besides Bahasa (another language) in public on Rey’s Auditory Verbal Learning Test and on time to complete the Figure Reproduction tests. Other tests, such as the TMT, Stroop, 5PT, and Bourdon were without any effect. It can be concluded that corrections for the normative data, as is commonly done for education, age and sometimes sex, for people who do not speak Bahasa daily and for speaking besides Bahasa (another language) considering that the differences were only small, is not indicated. After the viral outbreak that hit populations across the planet in the first half of 2020, it has been argued that the coronavirus pandemic can be described as a quintessential phenomenon of the Anthropocene, i.e. the result of a particular stage of socionatural relations in which wild habitats are invaded and anthropogenic climate change creates the conditions for the emergence of more frequent viral pathogens. Likewise, it has also been argued that the pandemic is an event that shares structural features (...) with climate change itself and, consequently, offers some lessons about how best to fight the latter. I will consider these arguments, offering an alternative view of the relationship between the pandemic and the Anthropocene. I will argue that although the pandemic should not be primarily seen as an event of the Anthropocene, it can end up reinforcing the Anthropocene frame for several reasons. (shrink)

The ideal of emancipation has been traditionally grounded on the premise that human activity is not restrained by external boundaries. Thus the realisation of values such as autonomy or recognition has been facilitated by economic growth and material expansion. Yet there is mounting evidence that the human impact on natural systems at the planetary level, a novelty captured by the concept of the Anthropocene, endangers the Earth’s habitability. If human development is to be limited for the sake of global sustainability, (...) can emancipation be kept as a mobilising ideal? As opposed to alternative views such as that of degrowth, this article argues that it can. The key lies in the ability of the Anthropocene to produce planetary subjectivities. By recognising the bounded quality of human embeddedness, the possibility of a different emancipation is opened up. The latter does not give up material well-being, yet it makes sure that the latter does not endanger planetary habitability. (shrink)

Since the 1960s, organ procurement policies have relied on the boundary of death—advertised as though it were a factual, value‐free, and unobjectionable event—to foster organ donation while minimizing controversy. Death determination, however, involves both discoveries of facts and events and decisions about their meaning (whether the facts and events are relevant to establish a vital status), the latter being subjected to legitimate disagreements requiring deliberation. By revisiting the historical origin of the dead donor rule, including some events that took place (...) in France prior to the report by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death, I want to recall that those who first promoted the DDR did not take into account any scientific rationale to support the new proposed criteria to determine death. Rather, through a process of factual re‐semantization, they authorized themselves to decide about the meaning of death in order to implicitly prioritize the interests of organ recipients over those of dying people. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. This paper explores the essential role of Artificial Intelligence (AI) competencies and literacy in the fields of records management and archival practices, within the framework of the InterPARES Trust AI project. As AI technologies advance, archival professionals must acquire specific skills and knowledge to effectively integrate these technologies into their workflows. The study employs two complementary approaches: (1) a detailed competency framework developed through literature reviews, interviews with archival professionals who have applied AI to the processing of records, and validation (...) workshops with practitioners; and (2) a comprehensive AI literacy framework derived from multiple case studies and theoretical discussions. Our empirical approach to derive these AI competencies for the archival professions is novel in the scholarly literature. Findings indicate that archival professionals can leverage AI in their work practices by acquiring basic AI literacy, practical AI skills, data-related skills, tool-testing and evaluation, adaptation of AI to their workflows, and by actively engaging in collaborative projects with information technology (IT) developers. In addition, there are significant ethical concerns regarding algorithmic biases and data privacy that need to be addressed. We support an interdisciplinary approach that combines archival science, computing, and ethical considerations to develop trustworthy AI solutions. By integrating these fields, practitioners can better understand and manage the implications of AI in their work. Arguments are presented to use our AI literacy and competency framework as a general guide to be refined and situated by archival educators and practitioners for professional development in their own specific contexts. To stay current with technological advances and fully leverage the potential of AI, continuous updates and development of AI literacy among records management and archiving professionals are crucial. This study highlights the need for continued education and interdisciplinary collaboration to achieve these goals. (shrink)

Los estados normativos solo pueden ser percibidos a partir de su frustración. Partiendo de esta premisa, el presente artículo propone una definición filosófica de la inseguridad social, basada en la reciente revisión de la función práctica y cognitiva de dos emociones tradicionalmente entendidas como negativas: el resentimiento y la ansiedad. Se analizará el resentimiento como un potencial generador de vínculos políticos en la memoria de un pasado de protección arrebatada, y la ansiedad como un indicador epistémico en condiciones de incertidumbre (...) objetiva. Se colige una definición de la inseguridad acotada entre la retención resentida del pasado y la proyección preventiva del futuro. Normative states can only be experienced from their frustration. Based on this premise, this article proposes a philosophical definition of social insecurity, based on the recent review of the practical and cognitive function of two emotions traditionally understood as negative: resentment and anxiety. Resentment will be analyzed as a potential generator of political links in the memory of a past of rapt protection, whereas anxiety wil be understood as an epistemic indicator in conditions of objective uncertainty. A definition insecurity will be set between the resentful retention of the past and the preventive projection of the future. (shrink)

A key issue in the business ethics field is the design of effective measures for assessing the ethical culture of organizations. The Corporate Ethical Virtues Model (CEV), developed by Kaptein in 2008, is an instrument for measuring ethical culture, and has been applied, adapted and validated in different contexts. In 2013, DeBode, Armenakis, Field and Walker developed the CEV–S, a shortened version of the original scale. Both the CEV and CEV–S assess eight dimensions based on corporate ethical virtues: clarity, congruency (...) of supervisors, congruency of senior management, feasibility, supportability, transparency, discussability and sanctionability. The objective of this study is to present a Spanish version of the CEV–S and its validation process. The scale was applied to two samples of 114 and 193 Colombian employees from two companies operating in the services sector. The confirmatory factor analyses revealed a good fit for the eight-factor structure of the Spanish CEV–S and the statistical tests applied showed good levels of reliability and validity for this scale. The adequate psychometric properties shown by the Spanish CEV–S may support its use in future research to measure organizational ethical culture in Spanish-speaking settings. (shrink)
